Terms of Service

Agreement to Terms

Golfund (the "Service") is operated by Golf Outing Productions, LLC ("GOP", "we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms of Service between you and GOP. If you do not agree to these terms, do not use the Service. These terms apply to all users, including event organizers, volunteers, and donors. Description of Service

Golfund is a point-of-sale application designed for charity golf events. The Service enables event organizers and volunteers to accept contactless payments via Tap to Pay on iPhone, track donations in real time, manage transaction categories, and export financial reports. Golfund facilitates payment processing through Stripe but does not itself process, store, or handle payment card data.

Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Service. By using Golfund, you represent that you meet these requirements and that you have the authority to accept these terms on behalf of any organization you represent.

User Accounts and Obligations

When using Golfund, you agree to:

• Provide accurate and complete information when creating an account.
• Maintain the security of your account credentials and not share them with unauthorized parties.
• Notify us immediately of any unauthorized access to your account.
• Use the Service only for lawful charitable fundraising purposes.
• Ensure that your use of the Service complies with all applicable local, state, and federal laws and regulations, including those governing charitable solicitations.
• Not attempt to reverse-engineer, decompile, or disassemble any part of the Service.

Payment Processing

All payment processing is provided by Stripe, and by using Golfund you also agree to Stripe's terms of service. Key payment terms include:

• A processing fee of 3% is applied to each transaction. This fee covers payment processing and platform costs. Golfers can opt out of covering the fee at checkout.
• Golfund does not store, process, or have access to payment card numbers or credentials. All card data is handled exclusively by Stripe.
• Transactions are initiated as pending and are confirmed only after successful processing by Stripe.
• Golfund is not responsible for payment failures, declines, or issues arising from Stripe's infrastructure.
• Event organizers using Stripe Connect receive funds directly to their connected Stripe account, minus applicable fees.

Refund Policy

Refunds for transactions processed through Golfund are managed by event organizers with admin or owner permissions. Refund requests should be directed to the event organizer. Golfund facilitates refund processing through Stripe, but the decision to issue a refund is at the discretion of the event organizer. Processing fees may not be refundable depending on Stripe's policies at the time of the refund.

Acceptable Use

You may not use Golfund to:

• Process payments for anything other than legitimate charitable fundraising activities.
• Engage in fraudulent, deceptive, or misleading practices.
• Violate any applicable laws, regulations, or third-party rights.
• Interfere with the operation of the Service, including introducing malware, viruses, or other harmful code.
• Attempt to gain unauthorized access to other users' accounts, data, or the underlying systems.
• Use automated systems (bots, scrapers) to interact with the Service without prior written consent.

Data Handling

Your use of Golfund is also governed by our Privacy Policy, which describes how we collect, use, and protect personal information. By using the Service, you consent to the data practices described in the Privacy Policy.

Intellectual Property

The Service, including its design, code, features, and content, is owned by Golf Outing Productions, LLC and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose. This license does not grant you any right to the underlying source code or intellectual property.

Limitation of Liability

To the maximum extent permitted by law, Golf Outing Productions, LLC and its officers, directors, employees, members, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Service. In no event shall our aggregate total liability to you for all claims relating to the Service exceed the greater of (a) the amount of fees received by GOP from your account in the twelve months preceding the claim, or (b) one hundred U.S. dollars ($100).

Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

Dispute Resolution

Any disputes arising out of or relating to these terms or the Service shall first be attempted to be resolved through good-faith negotiation between the parties. If a resolution cannot be reached within thirty (30) days, either party may pursue binding arbitration in accordance with the rules of the American Arbitration Association. Class action lawsuits, class-wide arbitrations, and representative actions are not permitted under these terms.

Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may stop using the Service at any time. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including liability limitations, dispute resolution, and intellectual property) shall remain in effect.

Modifications to Terms

We may revise these terms at any time by updating this page. Material changes will be communicated through the application or via email. Your continued use of the Service after changes are posted constitutes acceptance of the revised terms. If you do not agree with any changes, you must stop using the Service.

Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
